§ 1 Scope of application
These general terms and conditions apply to all business relationships between the customer or orderer and the supplier, Nationalparkzentrum Hohe Tauern GmbH - Gerlosstraße 18, 5730 Mittersill, which are initiated via www.nationalparladen.at initiiert werden.

§ 2 Prices
For the items ordered in the National Park shop, only the prices displayed in the shopping cart immediately prior to submitting the order apply. The prices include the statutory value added tax for Austria.

§ 4 Contract
By clicking on the "Book with obligation to pay" button to complete the order process after accepting the terms and conditions, you are submitting an offer to conclude a purchase contract with Hohe Tauern National Park Center GmbH. We will confirm receipt of your order on the subsequent web page as well as by email. However, neither confirmation constitutes acceptance of your offer; rather, it is intended to inform you that the correct order information has been received. We store your order data. Hohe Tauern National Park Centre GmbH has the right to decline your order in whole or in part due to unexpected delivery difficulties or if you fail a credit check. If we become aware of such circumstances, we will inform you by email within a reasonable period of time. If you have already made advance payments for undelivered goods, we will of course refund these. The contract between Hohe Tauern National Park Center GmbH and you is concluded when we ship the ordered items to you and send you a shipping confirmation. No purchase agreement is entered into regarding products that are part of the same order but that are not listed in the dispatch confirmation email.

§ 5 Delivery
You will receive the goods within a reasonable time, which is usually within 5 working days including the shipping route. If certain items are not immediately available due to high demand and the specified delivery time can therefore not be met, we will contact you no later than at the expiry of this period to come to an agreement with you as to whether the order should be maintained.

§ 6 Payment
Our payment service provider will debit the amount due from your account. Like all other personal details, your credit card information is transmitted securely (via SSL).

§ 7 Cancellation clause
You have the right to cancel this contract within 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods (or the last goods, partial shipment or piece in the case of a contract for several goods of a uniform order or the delivery of goods in several partial shipments or pieces) or from the day of the conclusion of the contract, without giving reasons. To comply with the cancellation deadline, it is sufficient for the notification regarding your exercise of the right of cancellation to be sent before the deadline and to have returned the goods within the period defined below. The consequences of a cancellation: If you cancel this contract, we will refund all payments for the purchased goods that we have received from you. The refund will be made immediately and, subject to the situations mentioned below, no later than within fourteen days from the day on which we received notification of your cancellation of this contract. We use the same payment method for the refund that you used for the original transaction, unless expressly agreed otherwise with you. We do not charge you a fee for the refund. We have the right to refuse payment until we have received the goods or until you have provided proof that the goods have been sent back, whichever is earlier. You must return the goods to us by post immediately and in any case no later than within fourteen days from the date on which you have notified us about your cancellation of the contract. The deadline is deemed adhered to if you post the goods before the expiry of the period of fourteen days. The regular costs for the return are borne by you. You have to pay compensation for any loss in value of the goods only of this loss in value is due to a handling of the goods that is not necessary in order to check their condition, characteristics or proper functioning. Exceptions to the right of cancellation The right of cancellation does not exist or ceases to apply for the following contracts: For the delivery of goods which are not suitable for return for reasons of health protection or hygiene and whose seal was removed after delivery or which were inseparably mixed with other goods after delivery due to their nature; For the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs; For the delivery of goods that spoil quickly or whose expiration date would be quickly exceeded; END OF THE CANCELLATION CLAUSE

§ 8 Reservation of title
Each delivered product remains the property of Hohe Tauern National Park Center GmbH until payment has been received in full.

§ 9 Warranty and compensation
Hohe Tauern National Park Center GmbH guarantees that the items delivered to you are free of defects. The statutory warranty regulations apply. Minor deviations of the goods do not constitute a defect that triggers a warranty claim. However, we cannot grant a blanket guarantee unless we expressly declare this. Hohe Tauern National Park Centre GmbH is not liable for slightly negligent breaches of duty insofar as these do not relate to damage from injury to life, limb or health or any guarantees granted, or affect claims under the product liability law. The same applies to breaches of duty by vicarious agents.

§ 10 Data protection and security
Your personal data as well as all other information regarding your order will be encrypted and transmitted via a secure SSL connection. We store your name and address as well as the order-related data. We of course guarantee the protection of your personal data in accordance with the provisions of the Data Protection Act (DSG). Your data will only be passed on to third parties in the context of fulfilling your order, such as for any necessary credit card, creditworthiness or address checks. We of course constantly strive to improve the product range and the service of the National Park shop for you. We regularly analyse customer and order data and the latest information from our email newsletter to help do this. § 11 Final provisions
Austrian law applies to the exclusion of the UN Sales Convention (CISG). The place of jurisdiction is the competent court in Salzburg.
